LoftyHire Terms of Service

Welcome to LoftyHire.

By using our services, you (the “Client”) agree to the following terms and conditions (the “Terms of Service”).

  1. Services: LoftyHire LLC provides staffing and headhunting services. We connect qualified candidates with employers looking to hire. Our services include but are not limited to job listings, candidate screenings, and recruitment consultations.

  2. Client Account: To access certain features of our service, Clients may be required to create an account. Clients are responsible for maintaining the confidentiality of their account information and for all activities under their account.

  3. Fees and Payments: The Clients agrees to pay the fees for services provided by LoftyHire as outlined at the time of payment. All fees are non-refundable unless otherwise stated in writing by LoftyHire.

  4. Non-Disclosure Agreement (NDA):
    a. The Client agrees to keep all confidential information, including but not limited to candidate details, hiring practices, and business strategies, confidential.
    b. The Client shall not disclose, use, reproduce, or otherwise exploit any confidential information, except as necessary in connection with the services provided by LoftyHire.
    c. The Client agrees not to engage in any business activities that directly compete with LoftyHire.

  5. Intellectual Property Rights: All content provided by LoftyHire, including text, graphics, logos, and software, is the property of LoftyHire or its content suppliers and is protected by international copyright laws.

  6. Limitation of Liability: LoftyHire shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services. LoftyHire shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from the conduct of any contractor or employee hired through our services post-engagement. While LoftyHire takes measures to connect clients with qualified candidates, the ongoing conduct of these individuals post-hire is the sole responsibility of the employing client.

  7. Non-Solicitation and No-Poaching: The Client agrees that all communication with any Candidate introduced by LoftyHire must occur exclusively through LoftyHire. The Client shall not directly or indirectly contact, solicit, or engage any Candidate without LoftyHire’s prior written consent. If the Client chooses not to hire a Candidate at the time of introduction, the Client is prohibited from hiring, contracting with, or engaging that Candidate in any capacity for a period of one year from the date of introduction.

  8. Indemnification: The Client agrees to indemnify and hold harmless LoftyHire LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to the Client’s use of the service, including all expenses, including reasonable attorney fees, arising out of or in any way connected with the conduct or actions of contractors or employees sourced through LoftyHire after their placement with a client.

  9. Termination: LoftyHire reserves the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if the Client breaches the Terms of Service.

  10. Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of Wyoming, United States of America.

  11. Changes to Terms of Service: LoftyHire reserves the right to modify these terms at any time. Clients are advised to review this page periodically for any changes.

  13. Refund and Replacement Policy: Upon the finalization of the payment for recruitment services, clients are not eligible for a refund. LoftyHire is committed to client satisfaction and offers two service options.
    Under the Handoff (Direct Hire) option, if a candidate hired through our services does not meet the expected performance criteria within the first seven (7) months of employment, LoftyHire will provide a replacement candidate at no additional cost.
    Under the Managed Staffing option, clients are entitled to unlimited candidate replacements at no additional cost, ensuring ongoing coverage and flexibility to meet evolving business needs.
    This policy ensures that while refunds are not available, clients receive the necessary replacement support to achieve successful and sustainable hiring outcomes.
